What is bankruptcy?

Bankruptcy is a process implemented through federal courts to assist both individuals and businesses who have become overwhelmed with debt to start over – in some situations, this process can result in debts being forgiven, but this is not always the case and it is important to know in advance that obligations such as child support or debts to the Internal Revenue Service will not be discharged. Usually, bankruptcy courts will resolve your financial burdens either by requiring that your assets be liquidated (within reason) to generate funds to satisfy creditors or by designing a repayment plan.  

The initial relief for many debtors is that the mere filing of the bankruptcy petition will issue one or more “stays” meaning that all actions against the debtor by creditors for the purposes of collecting debt must cease – this may include ending everything from harassing telephone calls to lawsuits and wage garnishment.  The process of filing for bankruptcy appears daunting for many clients that are already experiencing enormous stress – but it doesn’t have to be – Mr. Brumel will guide you through each step.
